 These Terms and Conditions (hereinafter referred to as "these Terms") govern the provision of products by Luvia Lighting (hereinafter referred to as "the Company") to you (hereinafter referred to as "the Customer"). Please read these Terms carefully before placing an order.

1. About Us

 We are a lighting fixture sales company based in Japan. For inquiries, please contact us by email at shop-support@luvialighting.com.

2. Intellectual Property Rights

 The copyrights, trademark rights, and other intellectual property rights to this site and the information provided in connection with this service (including, but not limited to, photos and videos published on the target site and promotional materials and publications issued by the Company; hereinafter referred to as "Target Information") belong to the Company or to the rights holders who have licensed their use to the Company.
 Unauthorized use of this information (including, but not limited to, reproduction, modification, uploading, posting, transmission, distribution, licensing, sale, or publication) is strictly prohibited by law.

3. Account and Password Responsibility

・Customers who agree to these Terms and submit the prescribed membership application shall acquire membership qualifications upon completion of the prescribed registration procedures.  Membership registration procedures must be carried out by the individual who will become the member. Registration by proxy is not permitted under any circumstances.
・Please note that membership applications from individuals whose membership qualifications have been revoked in the past, or from anyone else deemed inappropriate by the Company, may be refused.
・Entering Member Information: When performing membership registration procedures, please read the input instructions carefully and accurately enter the necessary information into the prescribed input form.
 Special characters, old kanji, Roman numerals, etc., cannot be used in the registration of member information. If these characters are registered, the Company will change them.

Password Management:
・Passwords shall be used only by the member themselves and shall not be transferred or lent to third parties.
・Members shall be responsible for managing their passwords, including regularly changing them to prevent them from becoming known to others.
・Any declarations of intent made to the Company using a password shall be deemed as declarations of intent by the member themselves, and all payments, etc., arising therefrom shall be the responsibility of the member.

4. Disclosure to Third Parties

・As a general rule, we will not disclose member information to third parties without the prior consent of the member.
 However, in the following cases, the Company may disclose member information and other customer information without the prior consent of the member:

(1) When disclosure is required by law.
(2) When the Company deems it
necessary to protect the rights, interests, reputation, etc., of the Company.
(3) Disclosure to third parties necessary for service provision (e.g., shipping companies).

・Customer information will be managed by the Company in accordance with our "Commitment to Personal Information Protection."
・The Company may use customer information for the purposes of providing services to members, improving service content, promoting service utilization, and ensuring the sound and smooth operation of services.

5. Order Confirmation

・Orders for products can only be placed through the online checkout on our website.
・When you place an order, we will review it and decide whether to accept or reject it (e.g., if an item is out of stock). If your order is accepted, a binding contract for the sale and purchase of products will be immediately formed between you and the Company, and we will send you an order confirmation.

6. Products

・Images of products displayed on our website and in brochures are for illustrative purposes only. While we make every effort to reproduce accurate colors, we do not guarantee that the images will precisely reflect the actual colors of the products.
・As all our products are handmade, there may be slight variations in finish, shape, and appearance. These are part of the product's individuality and unique value and are not considered defects.
・We may make minor changes to products to comply with laws or to make minor technical adjustments or improvements (e.g., for safety or performance enhancement).
・As standard, we will wire the products for the market of your country of residence. We bear no responsibility for the use of the product outside the market where it was sold, or for the product's non-compliance with electrical or wiring regulations outside that market.
・Unless otherwise agreed, the Customer shall be responsible for obtaining any necessary import licenses or consents (at their own expense) concerning the products, and for bearing any customs duties, excise duties, taxes, and fees.

7. Delivery

・Products will be delivered to the address specified by the Customer and become the Customer's responsibility from the time of delivery.
 Details regarding delivery methods and shipping fees will be stated in the order confirmation.
 Unless otherwise agreed, delivery will take place within approximately 60 days after payment.
・If there is a possibility of significant delay in delivery, the Customer may terminate the contract and receive a refund for undelivered products.
・If, before the contract is concluded, the Customer notifies in writing that strict adherence to a delivery deadline is essential, and the Company fails to meet that deadline, the Customer may terminate this contract. Otherwise, delivery times are approximate only.

8. Price

・Products are subject to taxes, customs duties, and fees (including customs clearance fees).
・The price of the products will be as stated in the order confirmation.

9. Our Warranty

・We offer a warranty (hereinafter referred to as "the Warranty") to provide free repairs if a product becomes faulty due to a manufacturing defect within one year from the date of delivery.
 If a faulty product cannot be repaired (or if repair is not economically viable), we will provide a replacement product of equivalent specifications..
・If a defect occurs after the warranty period, customers should arrange for paid repairs at their own expense or request repairs from an electrician in their area of residence..
・This Warranty does not apply to failures or damages resulting from non-compliance with our assembly and installation procedures, improper installation or operation, misuse, abuse, neglect, cleaning, or accident (including failure to follow instructions regarding the use of appropriate light bulbs)..
 This Warranty will not apply if the Company determines that the product has been disassembled or tampered with by anyone other than the Company. This Warranty does not cover patination or peeling of finishes.

10. Force Majeure

・Neither party shall be liable for any failure to perform all or part of its obligations under this Agreement due to natural disasters, war, civil unrest, infectious diseases, or other force majeure events.
 In the event of a force majeure event, either party may, after consulting with the other party, modify or terminate all or part of this Agreement.

11. Liability

・The Company assumes no responsibility for any loss or damage resulting from modifications to the products, or from the use of the products in a manner that does not comply with the instructions or health and safety warnings attached to them.
・The Company is not responsible for any third-party costs (such as electrician call-out fees or cancellation fees).
・The Company does not disclaim liability for product defects and will respond in good faith to the end.

12. Dispute Resolution

・[Governing Law] This Agreement shall be governed by and construed in accordance with the laws of Japan.
・[Exclusive Jurisdiction] Party A and Party B agree that the Tokyo District Court shall be the exclusive court of first instance for all disputes arising from this Agreement.

13. Language of the Terms

・This Agreement is prepared in English and translated into various languages.
 The English version shall be the original, and the Japanese version shall be prepared for reference.
 In the event of any conflict or inconsistency between these two language versions, the English version shall prevail.
